Manhattan Psychology Group, PC (“MPG”) takes privacy very seriously and is committed to safeguarding information provided to us. This Privacy Policy explains how MPG handles any personal information and data collected via the Electronic Daily Report Card Website www.e-drc.com (“Website”). The Privacy Policy is subject to the Electronic Daily Report Card - Terms and Conditions of Use (“Terms”) and should be read in conjunction with such Terms. MPG reserves the right to change, modify, add or remove portions of the Privacy Policy at any time for any reason. Any changes will be effective as of the date we post on the Website. Users may object to any changes within 20 days after they are posted on the Website by giving written notice to MPG and terminating the User’s account(s), in which case none of the proposed changes will be effective with respect to information that has already been collected from you, but may apply only to information MPG collects in the future.

Information MPG Collects
During your use of this Website, MPG may collect technical and usage information from you. This technical and usage information may be collected using “cookies” or other similar means and may be used to assist MPG’s web design team in maintaining and improving this Website, and to enhance and/or personalize your visits to the Website. MPG will not disclose to third parties any technical and usage data that identifies or could be used to identify you.

MPG may also collect and store information voluntarily provided by you, or about you provided by authorized Users, while accessing or using the Website. Such information may include account sign up and profile information, school information, contact information, and any behavioral information that you or other authorized Users enter such as home rewards, target behaviors, and scores. MPG will not sell your information to anyone. MPG will also treat as confidential and will not disclose or distribute, to any person not authorized herein or in the Terms, any information that identifies any User or patient/student, any personal or financial information, or any data associated with a particular patient/student’s eDRC or treatment, including home rewards, target behaviors, and scores associated with a patient/student, except as required or permitted by law or to protect MPG’s rights and property

MPG may store some limited information that may qualify as “Educational Records” under the Family Educational Rights and Privacy Act (“FERPA”). In accordance with FERPA, MPG uses such Educational Records only to provide its service to students, their parents, their providers and their teachers. MPG will not disclose Education Records to third parties without parental consent, and will not sell or rent this information to anyone. Furthermore, the Website enables students’ parents to access and review their own such Educational Records at any time. Use and Disclosure of Collected Information
MPG may use an aggregation of information and data collected by it from any or all of its Users, excluding any patient/student or User identifying information, for purposes that will not contravene the privacy provisions described above, including for research purposes by MPG.

MPG will not disclose any patient/student information unless required by law, such as in response to a judicial order or lawfully issued subpoena. If MPG is subject to a judicial order or lawfully issued subpoena compelling the disclosure of personally identifiable patient/student information, MPG will notify the Users associated with the patients/students concerned in advance of compliance in order to allow such Users to seek protective action and MPG will take reasonable steps to restrict disclosure by MPG within the bounds of the law.

Notwithstanding the above, MPG reserves the right to disclose the identity of Users to one another only for the limited purpose of offering a collaborative forum, such as an online group, to share ideas, obtain and provide resources, and ask questions amongst one another and with MPG regarding the features, functionalities, and use of the Website. MPG reserves the right to invite and/or add Users to an online forum or group for this purpose, which shall be closed to the general public. Users may opt out or withdraw at any time, or request not to be added in advance of using the Website, by written request to MPG.

How MPG Protects your Information
MPG strives to protect the privacy of Users and secure the information we receive. We maintain administrative, technical and physical safeguards designed to protect against unauthorized use, disclosure or access of the information we collect on this Website. The entire Website uses SSL encryption to ensure a secure connection between your browser and our servers. All Users have separate password logins and agree to the Terms and Conditions.

Disclaimer of Liability
While MPG shall take commercially reasonable efforts to safeguard the privacy of information provided to MPG, in no event will the information provided result in any liability on the part of MPG in the event that such information is inadvertently released by MPG or accessed by third parties without MPG’s consent.
